Cannabis Legislation In NJ Remains Stalled Despite Referendum

In November, New Jersey voters overwhelmingly approved an amendment to the state's constitution allowing the sale and consumption of cannabis for adults. That amendment takes effect Jan. 1, 2021. But the legislation that actually makes it legal doesn't exist yet.

The bills decriminalizing marijuana and establishing a cannabis industry are still sitting on Gov. Phil Murphy's desk. And that's leaving a legal gray area. The state Attorney General has asked prosecutors to postpone low level marijuana cases through the end of January. But that directive didn't stop arrests, though those are likely to be challenged in court.

Murphy is working with lawmakers to make last minute changes to the legislation. But even when the bills are finally signed, it's still going to be at least another year before you can walk into a dispensary and purchase legal cannabis.
