He and his friends went out for the Fourth of July, and Wells was the only one in the group who did not return. His body was found two days later. Jurors found no evidence of criminal wrongdoing in his death. Elise Gregg with Mississippi Public Broadcasting and the Gulf States Newsroom joins us now with an update. Hi, Elise.\u003Cp>\u003Cp>ELISE GREGG, BYLINE: Hi there.\u003Cp>\u003Cp>DETROW: Walk us through the findings and some of the major points in the grand jury report.\u003Cp>\u003Cp>GREGG: Right. So the Jackson County grand jury returned a no true bill. That means after they reviewed all the evidence presented, they decided there wasn't enough to indict anyone in Wells' death. The 23 jurors issued over a hundred subpoenas, heard from over 40 witnesses and reviewed evidence ranging from GPS data to cellphone extractions to photos and videos from Horn Island.\u003Cp>\u003Cp>Now, a couple of major points include the jury finding that Wells chose to stay on the island. And while autopsy results found the cause of death undetermined, but they did suggest drowning by exclusion. And jurors determined, based on where his body was found and the condition, his death was, quote, \"consistent with drowning.\"\u003Cp>\u003Cp>DETROW: Wells was the only Black teen in this group, and now his family has questions about this jury report. What are they saying?\u003Cp>\u003Cp>GREGG: Right. Now, the report does formally close the criminal case, at least for now. But, yes, there are absolutely still questions. Again, Wells was the only Black teen among his friends that day, and his family and attorneys have repeatedly questioned if the investigation would have gone differently with a white teenager.\u003Cp>\u003Cp>Now, a major point made by civil rights Attorney Ben Crump is that bruises on the back of Wells' head suggested blunt force trauma. The state medical examiner concluded those bruises weren't fatal, but here's Crump at a press conference in Georgia this afternoon.\u003Cp>\u003Cp>(SOUNDBITE OF PRESS CONFERENCE)\u003Cp>\u003Cp>BEN CRUMP: What really caused it? What really caused the blood in the back of his head? Yet the flames of that narrative, set against the backdrop of Mississippi's terrible history, were fanned by both people who knew the truth and those who didn't.\u003Cp>\u003Cp>GREGG: Now, the tension between Crump's team and the DA stems from an independent autopsy and the review of Wells' phone. Crump claimed that body parts were withheld from their forensic pathologist and that the DA didn't cooperate in coordinating a joint review of Wells' phone. Myers McIlrath denied all of that on Monday.\u003Cp>\u003Cp>DETROW: With the criminal case now closed, what comes next?\u003Cp>\u003Cp>GREGG: We may see some civil suits come out of this. Several of Wells' friends and former teammates have already threatened defamation lawsuits against everyone from Reverend Al Sharpton to social media influencers. Wells' family notified Wells' friends and their families that litigation was, quote, \"reasonably anticipated.\" And again, there are pushes to keep the investigation open and release the state autopsy. However, activists, attorneys and Wells' family are continuing to push for answers.\u003C\u002Fp>\u003Cp>During a press conference Tuesday, civil rights attorney Ben Crump highlighted a detail mentioned in the medical examiner's report: the bruising on the back of Wells' head, which the report said was not a fatal injury.\u003C\u002Fp>\u003Cp>\"Nolan Wells' parents deserve answers,\" said Crump, who is representing Wells' family. He urged the district attorney to keep the investigation open. \"What really happened to Nolan Wells? What caused the blunt force trauma to his head? That is the crux of the matter.\"\u003C\u002Fp>\u003Cp>The fact that the grand jury didn't find enough evidence to charge someone with a crime \"is not an answer to how 18-year-old Nolan Xavier Wells left for an outing with friends and never came home,\" the Rev. Al Sharpton, who led Wells' eulogy, wrote in a statement. \"We will not confuse the absence of an indictment with the presence of an answer.\"\u003C\u002Fp>\u003Cp>Following Crump's release of the independent autopsy report, the NAACP is pushing the district attorney's office to release its own report to the public.\u003C\u002Fp>\u003Cp>\"Nolan's family deserves nothing less than a full, fair, and independent investigation that is exhaustive and leaves no stone unturned,\" wrote Kristen Clarke, NAACP general counsel, in a statement. \"We urge the District Attorney to continue the investigation, release the full autopsy report from the state's medical examiner, and make the investigative file public.\"\u003C\u002Fp>\u003Cp>The grand jury, which met from Sept. 14 to Sept. 18, ultimately found that Wells' cause of death was undetermined and based on the condition of his body and where it was found, his death was \"consistent with drowning.\"\u003C\u002Fp>\u003Cp>\"The Grand Jury finds no credible evidence to support the public allegations that any persons who rode to or from Horn Island on July 4, 2026 on the Triton, the Palm Beach, or the Tideline engaged in any criminal conduct related to the death of Mr. Wells,\" the report, which is partially redacted, reads.\u003C\u002Fp>\u003Cp>The 23 jurors issued over 100 subpoenas, heard from over 40 witnesses and reviewed evidence ranging from GPS data to cellphone extractions to photos and videos from Horn Island, a barrier island off the coast of Mississippi.\u003C\u002Fp>\u003Cp>Evidence reviewed also included findings from Crump's team, including a report of what was on Wells' cell phone.\u003C\u002Fp>\u003Cp>However, Wells was the only Black teen among the group of friends that traveled to Horn Island on July 4, and his family has repeatedly questioned if the investigation would have gone differently with a white teenager.\u003C\u002Fp>\u003Cp>In a recorded statement released Monday night with the grand jury report, Jackson County District Attorney Angel Myers McIlrath said those concerns are baseless.\u003C\u002Fp>\u003Cp>\"The family, the Crump team, and anyone close to Nolan knew that his disappearance and death were not the result of racial hate or violence,\" Myers McIllrath said. \"Yet the flames of that narrative set against the backdrop of Mississippi's terrible history were fanned by both people who knew the truth and those who didn't.\"\u003C\u002Fp>\u003Cp>\u003Ch3>From July 4 to grand jury report\u003C\u002Fh3>\u003C\u002Fp>\u003Cp>Wells was found dead on Horn Island on July 6, two days after he boated there with several friends to celebrate Independence Day.\u003C\u002Fp>\u003Cp>Wells was the only member of the group who failed to return from the island, and the report says he chose to stay, characterizing it as, \"not unusual or suspicious for individuals to return from the island on boats they did not travel […] on.\"\u003C\u002Fp>\u003Cp>\"Nolan chose to stay on the island that day, and there is not a scintilla of evidence to contradict that,\" Myers McIlrath said in her recorded statement.\u003C\u002Fp>\u003Cp>The grand jury report emphasized that despite \"public assertions\" that the teen was the only Black person on the island that day, those assertions were false and \"led to misidentification, speculation, and rumors concerning the death of Mr. Wells.\"\u003C\u002Fp>\u003Cp>The grand jury determined there had been a \"thorough search\" of Horn Island on July 5 before Wells' body was discovered the following day.\u003C\u002Fp>\u003Cp>\"The Grand Jury is confident that had his body been on the island at that time, it would have been discovered during the extensive search,\" the report reads.\u003C\u002Fp>\u003Cp>\u003Ch3>Questions surrounding the state and independent autopsies\u003C\u002Fh3>\u003C\u002Fp>\u003Cp>Dr. Roger Mitchell, the forensic pathologist who performed an independent autopsy, concluded along with the state medical examiner that the cause and manner of Wells' death is \"undetermined\" and that \"drowning is a diagnosis of exclusion.\"\u003C\u002Fp>\u003Cp>Crump has previously said that Mitchell did not have access to parts of Wells' body during the independent autopsy. But the grand jury report disputes that assertion, noting that Mitchell had full access to the body, with the exception of internal neck structures in the custody of the state medical examiner.\u003C\u002Fp>\u003Cp>Bruises were found on Wells but were not considered fatal injuries. One was on the back of his head, which Crump addressed following the grand jury report Monday night.\u003C\u002Fp>\u003Cp>\"Mississippi's own pathologist found two bruises on the back of this young man's head and informed investigators of them early in this investigation,\" Crump wrote in a statement. \"An independent autopsy documented traces of blood and recent blunt force injuries to the back of Nolan's head and his back. To this day, not one person has explained how they got there.\"\u003C\u002Fp>\u003Cp>Crump released his team's independent autopsy on Monday night as well. That report recommends keeping the investigation open because of uncertainties surrounding Wells' death and the condition he was in when he entered the water.\u003C\u002Fp>\u003Cp>According to that report, the investigation doesn't make clear whether Wells entered the water \"voluntarily or was forced, whether he was conscious or impaired, or why he would have been unable to extricate himself despite reportedly being able to swim and while in the presence of other persons.\"\u003C\u002Fp>\u003Cp>But in her own statement on Monday night, Myers McIllrath said the Crump team has not been acting in good faith. She said they had previously \"advised my office that they had no evidence of a crime being committed against Nolan Wells.\"\u003C\u002Fp>\u003Cp>\u003Ch3>Cellphone review caused issues in investigation\u003C\u002Fh3>\u003C\u002Fp>\u003Cp>Among the issues Myers McIllrath addressed Monday is a dispute over Wells' cell phone.\u003C\u002Fp>\u003Cp>\"The state of Mississippi had no legal avenue to seize and search Nolan's cell phone,\" she said. \"Nolan's family and the Crump team have always been in complete control of Nolan's cell phone, including when, where, how and if the phone would be examined by the state.\"\u003C\u002Fp>\u003Cp>Wells' family and attorneys offered to share his phone's data with the state. However, Myers McIllrath said she never received the data or the complete results of the data analysis Crump's team solicited.\u003C\u002Fp>\u003Cp>\"After the grand jury convened in this case, the Crump team provided a 282-page selection of reports from Nolan's cell phone, which the grand jury considered,\" she said.\u003C\u002Fp>\u003Cp>However, her office did receive a report from Crump's team that indicated that nothing had been deleted from Wells' phone since his last use, she said.\u003C\u002Fp>\u003Cp>\"The Crump team knew better, but allowed the public to believe, among other false narratives, that our medical examiner withheld Nolan's lungs and stomach when his body was released, that things had been deleted off of Nolan's phone before it was given back to his family, that I refused to cooperate with the examination of Nolan's cell phone, that I refuse to provide Nolan's autopsy results to the family,\" she said. \"All lies.\"\u003C\u002Fp>\u003Cp>\u003Ch3>Litigation may continue\u003C\u002Fh3>\u003C\u002Fp>\u003Cp>Civil litigation may still be pursued in the case. On the day of Wells' funeral, attorneys for the family sent letters to Wells' friends and their families as notice that litigation was \"reasonably anticipated.\"\u003C\u002Fp>\u003Cp>In addition, a former teammate of Wells who went with him to Horn Island on July 4, may sue Wells' family for defamation.\u003C\u002Fp>\u003Cp>\"What we have seen happen in Nolan's case, where lives and reputations have been damaged, is reprehensible. People have suffered. In an email statement to NPR, Peters' representative, Mitchell Jackson, said Peters \"denies the allegations.\"\u003C\u002Fp>\u003Cp>A police narrative in the court documents states that the victim began communicating with Peters on Instagram, where he paid her to appear on his livestreams to help her \"make her name known on social media.\"\u003C\u002Fp>\u003Cp>The documents show that on May 23, 2025, Peters arranged for the minor to come to his home in Chatham, Mass.\u003C\u002Fp>\u003Cp>At his home, Peters allegedly instructed the victim to say she was 18 on his videostream and to claim the alcohol on camera was water instead of vodka. The victim said she felt peer-pressured to drink the spirit, and that she became noticeably intoxicated after a couple of drinks.\u003C\u002Fp>\u003Cp>The allegations go on to state that after stopping off the stream, Peters and the minor kissed on a couch and then had sex in his bed without her consent. The plaintiff said she did not receive a sexual assault forensic exam after the incident. NPR does not name alleged victims of sexual assault.\u003C\u002Fp>\u003Cp>The same teenager had previously filed a civil lawsuit in Florida against Peters alleging battery, fraud, intentional infliction of emotional distress, and unauthorized use of name\u002Flikeness. That complaint, filed in April in Miami-Dade County, included claims that Peters plied her with alcohol and engaged in non-consensual sexual acts at his parents' Cape Cod house while she was a minor, alongside claims that he injected her face with an unapproved fat-dissolving substance during a livestream.\u003C\u002Fp>\u003Cp>Andrew Moss, a lawyer representing the girl in the Miami case, confirmed that the plaintiff in both the Miami and Massachusetts cases are the same person.\u003C\u002Fp>\u003Cp>Peters' representative, Jackson, ridiculed how the plaintiff has handled the legal process. \"She files a lawsuit and doesn't include sexual assault as a count. Then she amends it and adds it a couple of months later,\" Jackson said in an email. \"Clavicular then filed a motion to dismiss fighting the civil lawsuit because letter\u002Ftext messages show she knew what was happening with the injections and he refused to pay money. She and her lawyer then go to police.\"\u003C\u002Fp>\u003Cp>This is not Peters' first run-in with the law.\u003C\u002Fp>\u003Cp>In March, for instance, the Osceola County Sheriff's Office in Florida issued an arrest warrant after law enforcement determined Peters instigated a physical fight between two women at an Airbnb rental and posted the footage online. He was taken into custody. The charges were later dropped.\u003C\u002Fp>\u003Cp>Then in April, Peters was charged with unlawfully shooting a firearm after a viral video showed Peters and others firing a gun at a dead alligator from an airboat in the Florida Everglades.\u003C\u002Fp>\u003Cp>Peters has not released an official public statement about the charges. But he did express disdain for the plaintiff in a series of social media posts on X.\u003C\u002Fp>\u003Cp>\"Trying to get my attention in any way possible, a lawsuit? Those were approved by the Trump-packed Commission of Fine Arts in May.\u003C\u002Fp>\u003Cp>But the word \"military\" did not surface until earlier this month, when Interior Secretary Doug Burgum announced \u003Ca href=\"https:\u002F\u002Fx.com\u002Fsecretaryburgum\u002Fstatus\u002F2095587973907755133?s=46&t=-aXH-trF90w0ZZmr0Jj8kg\" target=\"_blank\">on social media\u003C\u002Fa> that excavation work would soon begin at the \"Great Triumphal Arch and Military Observation Deck.\"\u003C\u002Fp>\u003Cp>That announcement drew immediate pushback — and a \u003Ca href=\"https:\u002F\u002Fwww.npr.org\u002F2026\u002F09\u002F04\u002Fnx-s1-5957459\u002Ftrump-arch-excavation-lawsuit-veterans\" target=\"_blank\">judge's intervention\u003C\u002Fa> — because it still needs a final green light from the National Capital Planning Commission. Birnbaum told the agency over email — and reiterated to NPR — that \"we view this MOA as DOA [dead on arrival].\"\u003C\u002Fp>\u003Cp>Birnbaum called the process \"whiplash-inducing.\" He said the next steps are unclear, especially since a fortified military site would presumably require additional measures, from fencing to security, that have not come before federal panels yet.\u003C\u002Fp>\u003Cp>The White House, Interior Department and National Park Service did not respond to NPR's questions about plans to submit new proposals for review. The administration has not sought it, citing a 1925 law that allowed for the construction of a pair of \u003Ca href=\"https:\u002F\u002Fsah.org\u002F2026\u002F06\u002F02\u002Fsah-statement-on-proposed-monumental-arch-in-memorial-circle-in-washington-dc\u002F\" target=\"_blank\">166-foot columns\u003C\u002Fa> at that location that were ultimately never built.\u003C\u002Fp>\u003Cp>The lawyer representing the veterans, Nicolas Sansone of Public Citizen Litigation Group, said \u003Ca href=\"https:\u002F\u002Fwww.citizen.org\u002Fnews\u002Fthe-law-is-clear-trumps-vanity-arch-cannot-move-forward-without-congressional-approval\u002F\" target=\"_blank\">in a statement\u003C\u002Fa> Sunday that \"the President's new justification for this wildly unpopular construction does nothing to cure its fundamental illegality.\"\u003C\u002Fp>\u003Cp>Trump said in his post that he agreed to convert the arch into a military complex \"at the strong request of the United States Military, and for national security purposes.\" A Pentagon spokesperson told NPR it had nothing to add beyond Trump's post.\u003C\u002Fp>\u003Cp>Harold Hongju Koh, a former State Department legal advisor who now teaches international law at Yale Law School, called Trump's justification \"laughable and pretextual.\"\u003C\u002Fp>\u003Cp>\"If there are dangers to which you need to have drones and snipers … Why don't you just move them there now?
