Judge Grants Delay in Homeowner Rebate Check Case

The city's law department is getting another week to defend Mayor Bloomberg's decision to withhold those $400 homeowner rebate checks. A state supreme court judge granted the city's request for a delay in a case filed by Staten Island Councilman Vincent Ignizio and other Council members. The mayor still maintains the city cannot afford the rebates this year.

BLOOMBERG: If we send the rebate out, just think every other tax is going to go up the S400.

REPORTER: The mayor says the city can't cover the $256 million it costs to send out the checks. City council members say they should've been sent out in October because they were planned in the last budget.

The case is scheduled to resume next Thursday.
