Behind the Scenes Battle in the NYPD Disciplinary Trial

The disciplinary trial of police officer Daniel Pantaleo resumes Wednesday following a two-week hiatus. Pantaleo is accused of choking Eric Garner to death nearly five years ago. A viral video of the altercation showed Garner gasp the words, “I can’t breathe,” eleven times.

The trial has dragged on now for over three weeks, as behind-the-scenes a court battle is taking place. It’s a legal fight between the powerful police union and the Civilian Complaint Review Board, an outside police oversight agency, and the implications extend far beyond the Pantaleo trial. The result could determine who gets to investigate allegations of police misconduct throughout the system — internal investigators or civilians from the CCRB.
